What am I registering for?

You're registering your support for having the issue of permanent short-term rental accommodation put to a formal vote of ONE owners. Registration is not itself the formal strata vote and doesn't commit you to voting for a particular outcome.

Are we trying to ban all Airbnb?

No. NSW law limits what a strata by-law can prohibit. Section 137A of the Strata Schemes Management Act 2015 allows an owners corporation, by special resolution, to prohibit short-term rental accommodation where the lot is not the host's principal place of residence. That provision can't be used to prohibit short-term rental accommodation where the lot is the host's principal place of residence.

Can ONE legally restrict permanent Airbnbs?

NSW strata law allows an owners corporation, by special resolution, to make a by-law prohibiting short-term rental accommodation where the lot is not the host's principal place of residence. Any proposed by-law would need to go through the appropriate owners corporation process and formal vote.

What is a special resolution?

A special resolution is a formal owners corporation decision with a higher voting threshold than an ordinary resolution. Under current NSW strata rules, a special resolution passes where no more than 25% of the value of votes cast, calculated by unit entitlement, are against the resolution.

What is unit entitlement?

Unit entitlement is the number allocated to your lot under the strata scheme. It's used for various strata purposes and is relevant to how votes are calculated for a special resolution.

Where can I find my unit entitlement?

Check your strata roll, levy notice or other strata documentation for the unit entitlement allocated to your apartment. If you can't find it, don't worry — unit entitlement is optional on the registration form.

Why do you need my unit number?

Your unit number helps confirm that registrations come from genuine ONE Apartments owners.

Why do you need my phone number?

Your phone number lets the campaign organiser verify an owner registration if necessary, and contact you with important information relating to the proposed vote.

Will my details be made public?

No. Registration details will remain confidential and won't be published. They'll be held by the campaign organiser and used only for purposes connected with this owner initiative.

Does registering mean I've voted to ban Airbnb?

No. Registering means you support having the issue put to ONE owners for a formal vote. The formal strata vote is a separate process.

Can apartments still be rented to long-term tenants?

Yes. This proposal concerns short-term rental accommodation. It doesn't seek to prohibit ordinary residential tenancies.

What happens next?

Support is currently being gathered from ONE owners. The objective is to demonstrate sufficient owner support to progress the issue through the appropriate owners corporation process and have owners formally vote on it. Registering allows the campaign organiser to keep you informed as the process develops.
